1. Any order from a customer for stationery from The Designer Card Company Ltd is deemed to constitute understanding of and agreement to the following terms and conditions.

2. These terms and conditions are updated from time to time without notice to our customers.

3. All prices given by The Designer Card Company Ltd include VAT at the current rate where applicable.

4. All designs are the copyright and property of The Designer Card Company Ltd. Neither you, nor a third party, may copy any part of the design or reproduce it in any way.

5. It is your responsibility to obtain permission for any copyright material, for example hymns or poems that are to feature in the stationery.

6. The Designer Card Company Ltd requires your non-refundable full payment of the total order value, at the time you place your order with The Designer Card Company Ltd. Work cannot commence on your order until we have received the full payment. Proofs will then be sent to you by email and full proof approval must be received in writing. Both written proof approval and full cleared payment to the Designer Card Company Ltd are required before printing will commence. Please make all cheques payable to ‘The Designer Card Company Ltd’.

7. Should an order be cancelled at any stage after the full payment has been received by The Designer Card Company Ltd, The Designer Card Company Ltd cannot offer a refund of any amount.

8. You are responsible for the proof reading of all text and copy in the electronic proofs supplied. As a rough guide please refer to the proof checklist provided on The Designer Card Company Ltd’s website at the following address: www.designercardcompany.co.uk/proofing.html

The Designer Card Company Ltd strongly recommends that you print all proofs in order to view it to the correct size. The Designer Card Company Ltd will not begin print production until written approval is received.

9. The Designer Card Company Ltd recommends that all Menu Cards are proofed by both yourself and the designated catering company or provider.

10. Please note that The Designer Card Company Ltd is not able to accept returns due to customer input or typographical errors. When your final proof is approved you accept responsibility for any errors. If mistakes are discovered after final proof approval, The Designer Card Company Ltd reserves the right to charge for any reprinting. The cost of this will be entirely dependent on the nature of the job concerned.

11. Please note that samples may not exactly match the finished product due to variations in the print production process. Press set-up, plates, ink and paper can all result in small variations. Minor differences in texture, colour, size and positioning can sometimes occur and do not constitute a fault or a refund.

12. Please be aware that colours will appear differently on screen (as seen through light) than they will when printed (pigment on paper). If unsure always request a sample to approve.

13. The Designer Card Company Ltd accepts no responsibility for the effect of ageing on the materials used.

14. The Designer Card Company Ltd is not responsible for damage to your stationery after it leaves our design studio. This includes damage during delivery and subsequent posting to guests.

15. The Designer Card Company Ltd offers DIY (do it yourself) products at lower prices than our standard, pre-made products. The Designer Card Company Ltd does not recommend the purchase of such products to customers who are not experienced crafters. Although full instructions are provided it is the customer’s sole responsibility to ensure that they fully understand the process involved in making DIY products and to ensure that they are able to undertake this task. The Designer Card Company Ltd cannot accept any responsibility if the customer finds that they are not happy with the results they achieve having committed to purchasing DIY products and having undertaken the task of making their own stationery items. No refunds will be offered as a result of such an outcome.

16. As a standard policy we only make refunds and exchanges if goods are faulty. Any faults or defects must be relayed in writing within three days of receiving your order and your complete stationery order returned directly to us and not via a third party, in its entirety, packed securely so as to avoid any damage likely to be incurred during transportation.

17. If your stationery is deemed to be faulty on the part of The Designer Card Company Ltd the same will of course correct or replace your stationery with replacements, or, if it is not possible to provide replacements The Designer Card Company Ltd will offer an alternative or similar replacement.

18. The Designer Card Company Ltd may offer you a refund for the amount paid for the faulty part of your order if we are unable to correct or replace your stationery. The Designer Card Company Ltd will only offer a full refund if the order is faulty in its entirety.

19. We reserve the right to use any stationery we create for you to promote our products and services. We also reserve the right to use any stationery designed for you for future customers.

20. Every effort is made to display the prices accurately. However, on rare occasions, mistakes happen. In this instance The Designer Card Company Ltd will correct the mistake and inform the customer so that they can decide whether to continue with the order at the correct price.

21. Any dates quoted for delivery of orders are approximate only and The Designer Card Company Ltd shall not be liable for any delay in delivery of the orders however caused. Time for delivery shall not be of the essence unless previously agreed by The Designer Card Company Ltd in writing.

22. If The Designer Card Company Ltd fails to deliver the order for any reasons other than any cause beyond The Designer Card Company Ltd’s reasonable control or the Customer's fault and The Designer Card Company Ltd is liable to the Customer, The Designer Card Company Ltd’s liability shall be limited to the invoice price of the goods.

23. In the event of a claim, settlement will be limited to the value of the goods defectively produced and will in no way extend to consequential loss, howsoever caused.

24. Risk of damage to or loss of the goods shall pass to the customer at the time of delivery or, if the customer wrongfully fails to take delivery of the goods at the time when The Designer Card Company Ltd had tendered delivery of the goods.

25. The Designer Card Company Ltd shall not be liable to the customer or be deemed in breach of the agreement by reason of any delay in performing, or any failure to perform any of The Designer Card Company Ltd's obligations in relation to the goods, if the delay or failure was due to any cause beyond The Designer Card Company Ltd's reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond The Designer Card Company Ltd's reasonable control:

a) Act of God, explosion, flood tempest, fire or accident

b) War or threat of war, sabotage, insurrection, civil disturbance or requisition.

c) Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of governmental, parliamentary or local authority

d) Import or export regulations or embargoes

e) Strikes, lock-outs or any other industrial actions or trade disputes (whether involving employees of The Designer Card Company Ltd or of a third party)

f) Difficulties in obtaining raw materials, labour, fuel, parts or machinery.

g) Power failure or breakdown in machinery.

26. Any dispute, claims or proceedings of whatever nature between The Designer Card Company Ltd and the Customer in connection with or arising out of the validity, construction or performance of this agreement shall be subject to the non-exclusive jurisdiction of The High Court of England and Wales, to which both parties irrevocably submit.

27. The validity, construction and performance of this agreement shall be governed by English Law. These terms and conditions do not affect your statutory rights.
